These Terms of Service ("Terms") govern your access to and use of the Cadence ITIL 4 Academy ("Cadence", "we", "us", or "our"), including the website, learning content, simulations, battle cards, and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility & account
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to create an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly if you suspect unauthorised access.
2. Your licence to use Cadence
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access the Service for your own learning and professional development. You may print or download battle cards and other downloadable materials for personal, non-commercial use.
3. Acceptable use
You agree not to:
- resell, sublicense, or redistribute the learning content;
- scrape, crawl, or systematically copy the Service or its data;
- use the Service to harass, harm, or impersonate others;
- attempt to defeat security controls, rate limits, or access restrictions;
- upload malicious code or content that infringes the rights of others.

4. User content
You retain ownership of profile information and any notes, answers, or content you submit. You grant Cadence a worldwide, royalty-free licence to host, store, and display your content solely to operate and improve the Service.
5. Intellectual property
All Cadence-authored content — including written lessons, scenarios, branching stories, battle cards, code, and design — is owned by Cadence or its licensors and protected by copyright and other laws. ITIL® is a registered trademark of PeopleCert. Cadence is independent and is not affiliated with, sponsored by, or endorsed by PeopleCert or AXELOS.
6. No certification or professional advice
Cadence is an independent learning resource. Completing modules, scenarios, or practice exams on Cadence does not grant any official ITIL® qualification, and Cadence does not issue ITIL® certifications. Content is for educational purposes only and is not a substitute for legal, security, or professional advice tailored to your environment.
7. Subscriptions, payments, and refunds
If paid plans are offered, applicable fees, billing terms, and refund eligibility will be presented at the point of purchase and will form part of these Terms. Taxes may apply based on your location. You are responsible for any third-party costs (e.g. internet access).
8. Termination
You may stop using the Service at any time and request account deletion via the methods in our Privacy Policy. We may suspend or terminate accounts that violate these Terms, create risk to others, or remain inactive for an extended period.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. See our Disclaimer.
10. Limitation of liability
To the fullest extent permitted by law, Cadence and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of the Service. Our aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid Cadence in the 12 months preceding the claim, or (b) USD $50.
11. Changes to the Service or Terms
We may update the Service and these Terms from time to time. Material changes will be announced in-app or by email where appropriate. Continued use after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction where Cadence is operated, without regard to its conflict-of-law provisions. Disputes will be resolved in the competent courts of that jurisdiction unless mandatory consumer-protection laws provide otherwise.
